Terms and Conditions

Article 1 – Definitions

In these terms and conditions the following definitions apply:

• 1. Cooling-off period: the period within which the consumer may exercise the right of withdrawal;
• 2. Consumer: the natural person who does not act in the exercise of a profession or business;
• 3. Day: calendar day;
• 4. Duration transaction: an agreement relating to a series of products or services;
• 5. Durable medium: any means enabling storage of information for future consultation;
• 6. Right of withdrawal: the option for the consumer to withdraw from the agreement;
• 7. Model withdrawal form: the form provided by the entrepreneur;
• 8. Entrepreneur: the natural or legal person offering products or services remotely;
• 9. Distance contract: an agreement concluded via remote communication;
• 10. Means of distance communication: communication without physical presence;
• 11. Terms and conditions: these general terms and conditions.

Article 2 – Identity of the entrepreneur

Article 3 – Applicability

1. These terms apply to every offer and every distance contract.
2. The terms are made available before concluding the agreement.
3. If concluded electronically, the terms are provided digitally.
4. In case of conflict, the most favorable provision for the consumer applies.
5. Invalid provisions do not affect the remaining terms.
6. Unregulated situations are assessed according to the spirit of these terms.
7. Ambiguities are interpreted in accordance with the spirit of these terms.

Article 4 – The offer

1. Limited validity or conditions are stated clearly.
2. The offer is non-binding.
3. Descriptions are accurate and complete.
4. Images and specifications are indicative.
5. Colors may differ from actual products.
6. The offer clearly states price, delivery, payment and rights.

Article 5 – The agreement

1. The agreement is concluded upon acceptance.
2. Electronic acceptance is confirmed by the entrepreneur.
3. Secure data transmission is ensured.
4. Orders may be refused with valid reason.
5. Required information is supplied upon delivery.
6. For subscriptions this applies to the first delivery.
7. Agreements depend on product availability.

Article 6 – Right of withdrawal

1. Consumers may withdraw within 14 days after receipt.
2. Products must be handled with care.
3. Withdrawal must be reported within 14 days.
4. Failure to do so finalizes the purchase.

Article 7 – Costs in case of withdrawal

1. Return costs are borne by the consumer.
2. Refunds are processed within 14 days.
3. Damage due to misuse may reduce refund.
4. No liability if withdrawal information was incomplete.

Article 8 – Exclusion of withdrawal

1. Withdrawal may be excluded for custom or hygienic products.
2. Also excluded: perishable goods, sealed media, personalized items.
3. Services begun with consent are excluded.

Article 9 – The price

1. Prices remain valid during the offer period.
2. Variable prices may apply.
3. Increases within 3 months only by law.
4. All prices include VAT.
5. Typographical errors do not bind the entrepreneur.

Article 10 – Conformity and warranty

1. Products comply with the agreement.
2. Warranty does not affect legal rights.
3. Defects must be reported within 2 months.
4. Warranty excludes misuse or modifications.

Article 11 – Delivery and execution

1. Orders are executed with due care.
2. Delivery address is provided by the consumer.
3. Delivery within 30 days unless agreed otherwise.
4. Delays grant right of cancellation.
5. Refunds are processed within 14 days.

Article 12 – Duration transactions

Subscriptions may be cancelled monthly. Renewals are subject to legal limits.

Article 13 – Payment

1. Payments must be made within 7 working days.
2. Incorrect details must be reported.
3. Collection costs may apply.

Article 14 – Complaints procedure

1. Complaints are handled promptly.
2. Complaints must be submitted within 2 months.
3. Response within 14 days.
4. EU ODR platform may be used.

Article 15 – Disputes

Dutch law applies. The Vienna Sales Convention does not apply.

Article 16 – Additional provisions

Additional provisions must not disadvantage the consumer and must be recorded in writing.
